DIGIT ZERO CO., LTD. (hereinafter referred to as “we” or “FlowReg”) operates a platform that enables you, as a user (“User”), to search for various types of events, access information and promotions that may interest you, make reservations to attend events, and process payments (if necessary). This includes entering into agreements (if applicable) with users, checking in, and participating in any activities held at such events, as well as performing other operations facilitated by FlowReg for users.
FlowReg services may be accessed through our website (www.FlowRegapp.com), mobile applications, computer programs, social media pages operated on third-party platforms, or other services provided via email, mobile devices, or the internet, as deemed appropriate by FlowReg (hereinafter referred to as the “Platform”).
FlowReg prioritizes and respects your privacy rights as a user and the owner of personal data protected under the Personal Data Protection Act B.E. 2562 (hereinafter referred to as the “PDPA”). To this end, FlowReg has established this Privacy Policy to inform you about the details regarding the collection, use, and disclosure of your personal data, as well as your legal rights as the data owner.
The User acknowledges and agrees that FlowReg serves as an intermediary platform connecting event organizers and users participating in activities. Therefore, some processing of personal data (excluding the direct processing of personal data by FlowReg for the provision of its specified platform services) is conducted by FlowReg on behalf of and under the instructions of event organizers. In such cases, FlowReg acts as a data processor as defined under the PDPA, processing your personal data solely on behalf of the event organizer.
In the event of disputes or complaints related to the processing of personal data by FlowReg under the instructions of event organizers, please note that FlowReg’s role will be limited to facilitating communication between the user and the event organizer to address and resolve such disputes or complaints.
By accessing the platform and/or using our services, whether or not you have registered, FlowReg considers that you have read and understood this Privacy Policy. FlowReg reserves the right to amend or update this Privacy Policy from time to time. We will notify you of any changes by publishing updates through our communication channels. Once the updated Privacy Policy is published, your continued use of the platform will indicate that you have read and understood the terms of the revised Privacy Policy.
If you click on any link from FlowReg that directs you to third-party websites and/or platforms, please be aware that the handling of your personal data will be governed by the independent privacy policy of such third-party providers. FlowReg cannot guarantee or provide any assurances regarding the processing of personal data by those third parties.
FlowReg may collect your personal data from the following sources:
1. Directly from Users: When you contact us through various communication channels (both online and offline), log in to the platform, or use any service provided by FlowReg.
2. Automatically via the Platform: When you visit FlowReg's platform or related platforms, your personal data may be automatically collected and recorded.
3. Indirectly from Other Sources: FlowReg may collect or receive your personal data from lawful third-party sources, partners, social media, or other public sources. This may also include data provided by others with your consent to share such information with FlowReg (e.g., participant lists from other entities or public agency platforms). In such cases, FlowReg will inform you about the source of the data.
FlowReg must collect, use, and process the following personal data from users:
1. For Individual Users: This includes full name and contact information, particularly email addresses, for sending event participation confirmation details.
2. Device and Connection Data: Such as IP address, MAC address, cookies, device ID, connection details, browsing and platform access history, time zone settings, location data, browser plugin types and versions, operating platform details, and other technologies associated with your device. This also includes usernames and passwords for your user accounts.
3. Payment Information: Specifically for event participation fees set by event organizers (if applicable), such as bank account numbers, payment proof, or credit card details.
4. User Account Information: Including user IDs, login details, electronic signatures, transaction data on the platform, or through other communication channels. This includes event participation history, registration data, check-in records, and other related transaction details.
5. Contact and Feedback Data: Including inquiries, complaints, or feedback provided to FlowReg, as well as interests and preferences shared with us.
6. Event Photos and Media: Including images or videos captured during events, which may be taken onsite at actual event venues. These may consist of group or activity photos, either still or motion pictures.
FlowReg will process your personal data for the following purposes and in compliance with the applicable legal bases:
1. Contractual Obligations FlowReg processes your personal data to fulfill contractual obligations or to perform responsibilities you may request from FlowReg under the platform's terms and conditions. This includes, but is not limited to:
(a) Responding to your inquiries regarding the platform and/or services, providing event recommendations matching your interests, coordinating reservations and participation in events you have registered for, and offering other support services such as handling questions, requests, feedback, complaints, claims, disputes, or remedies. This also includes resolving issues and maintaining relevant records for refund or compensation processes you may submit.
(b) Identifying and linking your identity to transactions conducted on the platform in compliance with the terms and conditions and facilitating platform services, including coordinating and supporting transactions you may perform via FlowReg.
(c) Providing other services or fulfilling other contractual agreements or obligations you may request, such as facilitating participation in events organized by FlowReg.
2. Legal Obligations FlowReg processes personal data to comply with legal or regulatory requirements. This includes fulfilling obligations related to accounting and tax documentation under accounting and tax laws and other requirements imposed by laws, regulations, court orders, or directives from relevant government authorities.
3. Legitimate Interests FlowReg may process your personal data to achieve legitimate business interests, ensuring that such processing does not unreasonably infringe upon your rights and freedoms. This may include:
(a) Collecting statistics on platform usage and conducting data analysis to improve services and platform functionality, tailoring services to your needs, categorizing users to enhance service quality, and improving your experience on FlowReg's platform.
(b) Monitoring and detecting fraud or suspicious or illegal transactions conducted through the platform, in line with FlowReg's risk management framework.
(c) Managing complaints or legal proceedings related to claims or disputes you may submit or that FlowReg must address.
(d) Ensuring the security of IT systems, monitoring activities to prevent and report crimes, safeguarding the business integrity of FlowReg, and managing internal operations, reports, and policies.
4. Consent FlowReg may process your personal data for specific purposes based on your consent. This includes contacting you to provide information about services, events, promotions, or news you may be interested in, ensuring you receive relevant and up-to-date information tailored to your preferences.
If you do not provide your personal data to FlowReg for the purposes outlined in this Privacy Policy, you may be unable to access or fully utilize certain services and/or parts of the platform. In some cases, FlowReg may not be able to register your account or provide services and/or access to the platform.
FlowReg will retain and process your personal data as long as it is legally necessary for the purposes outlined in this Privacy Policy (particularly while you remain a user of the platform and/or FlowReg's other services). Additionally, to establish or defend legal claims, FlowReg may retain your personal data for up to 10 years from the date of the transaction. If FlowReg is legally required to retain your personal data for a longer period, the data will be kept in compliance with the applicable laws.
In principle, the personal data you provide to FlowReg will be kept confidential. However, FlowReg may need to disclose or transfer your data to the following parties:
* Event Organizers As FlowReg serves as a platform connecting users (as event participants) with event organizers, it may be necessary to share your registration data, payment details (if any), and other relevant information with the organizers. This ensures your effective participation in the events you registered for, as per your intent.
FlowReg will only disclose your personal data to the extent necessary. However, once your data is shared with event organizers, FlowReg cannot guarantee that the organizers will not process your personal data for additional purposes. FlowReg recommends contacting the organizers directly and reviewing their privacy policies for further clarity.
* External Service Providers FlowReg may disclose your personal data to external service providers who support its operations. This includes, but is not limited to, IT platform providers, financial institutions, external auditors, and consultants. FlowReg ensures that personal data is disclosed only as necessary and under the terms of a data processing agreement signed with these external service providers.
* Third Parties Involved in Organizational Restructuring FlowReg may disclose your personal data to third parties involved in organizational restructuring, mergers, acquisitions, sales, joint ventures, transfers, or other dispositions of all or part of its business, assets, or shares—whether proposed or actual. This includes any activities related to bankruptcy or similar proceedings. Such disclosures will only be made as necessary and under data processing agreements signed with the involved parties.
* Government Agencies FlowReg may be required to disclose or transfer your personal data to government authorities, law enforcement agencies, courts, officials, regulatory bodies, or as per legal orders. This includes obligations to comply with anti-money laundering laws, securities regulations, or other legal requirements.
* With your explicit consent, FlowReg may disclose your personal data to other parties as specified by you. This may include FlowReg affiliates for purposes such as communication and marketing.
FlowReg places great importance on the security of your personal data. It implements advanced physical and technical measures to ensure your data is not lost, accidentally destroyed, misused, disclosed, or accessed by unauthorized individuals. FlowReg has established internal policies and control measures to provide assurance that your personal data is handled securely. Additionally, FlowReg employees are regularly trained to manage personal data responsibly in line with company policies.
FlowReg respects your legal rights as the owner of your personal data under its control. You can exercise the following rights, subject to the relevant laws:
